Terms and Conditions for PRO X STUDIOS

1. Introduction

Welcome to PRO X STUDIOS. These Terms and Conditions govern your use of our educational web and mobile applications, which are accessible via platforms such as the Google Play Store, the Apple App Store, and our official websites. By downloading, accessing, or using our applications, you agree to be bound by these Terms.

2. Nature of the Services

PRO X STUDIOS provides digital educational tools primarily designed to assist South African learners from Grade 9 to Grade 12. Our platforms offer:

  • Educational content adhering to the South African Curriculum and Assessment Policy Statement (CAPS).
  • Artificial Intelligence (AI) tools designed to assist learners with past assessments, homework, and AI-generated question papers.
  • Access to official South African provincial and national past question papers.

3. No Government Affiliation

PRO X STUDIOS is an independent, private software development business. We are not affiliated with, endorsed by, funded by, or connected to the South African Department of Basic Education, any provincial education departments, or any government entity.

4. Pricing and Free Content

PRO X STUDIOS is committed to accessible education. All content on our platforms that is not generated by our proprietary AI models or uniquely created by PRO X STUDIOS (including, but not limited to, official national and provincial past question papers) is made available to users completely free of charge.

5. Age Restrictions and Legal Capacity

Our services are designed to be safe and accessible for users from the age of 3 years and older. However, in accordance with South African law, individuals under the age of 18 ("minors") have limited capacity to enter into legally binding contracts.

  • Parental Consent: If you are under the age of 18, a parent or legal guardian must read, understand, and accept these Terms and Conditions on your behalf before you use our applications.
  • By registering for or using our applications, you represent and warrant that you are either 18 years of age or older, or that you have obtained the explicit consent of your parent or legal guardian to use the services and agree to these Terms.

6. Free Access and Premium Interactions

Users are granted a limited allowance of seven (7) free interactions with our premium features, which includes AI-generated messages and unique content generation.

  • Prior to account creation, user data and app activity are stored locally on the user's device. If the application is deleted or the device is lost, PRO X STUDIOS is not responsible for the loss of any locally stored data.
  • Once the seven free interactions have been exhausted, users must purchase a subscription to continue accessing the premium AI features. These free interactions are tied to the user's account or device and cannot be transferred, sold, or exchanged.

7. Account Registration and Personal Information

To fully utilize the application and access premium features, users are required to create a formal account.

  • Information Collected: To create an account, we require your name or nickname and a valid email address. To better tailor our services to the learner’s specific needs, we may also ask users to complete a questionnaire regarding their subject proficiency levels.
  • POPIA Compliance: All personal information is collected, processed, and stored in accordance with the Protection of Personal Information Act (POPIA) of South Africa. We only collect data necessary to provide and improve our educational services.

8. Data Storage and Analytics

User data and interactions are securely processed and hosted on Google servers. We utilize this data strictly for analytical purposes to continuously improve our services and uniquely cater the educational experience to the learner. While personal information is governed by POPIA, any anonymized, aggregated, or non-personal analytical data generated through your use of our features remains the exclusive property of PRO X STUDIOS.

9. Payments, Subscriptions, and Third-Party Vendors

PRO X STUDIOS offers three auto-renewing subscription tiers (Weekly, Bi-Weekly/14-Day, and Monthly) for uninterrupted access to premium features.

  • Payment Processing: Payment processing is handled by secure third-party vendors (such as Google Pay, Paystack, or similar payment gateways). For payment verification purposes, we may require users to provide their official first and last names to attach to their profile.
  • Auto-Renewal: Payment will be charged to your chosen payment method at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off or the subscription is canceled before the end of the current billing period.
  • Third-Party Data Collection: Third-party payment vendors may collect additional financial and personal information governed by their own privacy policies. PRO X STUDIOS does not store your credit card or sensitive banking details on our servers.

10. Cancellation and Refund Policy

  • Cancellations: Users may cancel their subscription at any time through their account settings or the respective app store account management page. The cancellation will take effect at the end of the current paid billing cycle, and users will retain full access to all premium features until that expiration date.
  • Refunds: All purchases and subscription payments made to PRO X STUDIOS are final and non-refundable. We do not provide refunds, credits, or prorated billing for partially used subscription periods or unused premium interactions. Billing errors by third-party vendors must be disputed directly with that vendor.

11. AI Educational Aid Disclaimer

The Artificial Intelligence (AI) features provided within the PRO X STUDIOS applications are intended solely as educational aids and supplementary tutoring tools.

  • No Guarantee of Outcomes: PRO X STUDIOS makes no guarantees regarding academic performance, grades, or assessment outcomes resulting from the use of our applications.
  • Limitation of Liability: PRO X STUDIOS, including its directors, employees, and affiliates, shall not be held liable for any direct or indirect consequences arising from the use of our app. This includes, but is not limited to, academic penalties (such as those related to plagiarism), school disciplinary actions, or any impacts on the user's mental, emotional, or physical well-being.

12. Acceptable Use and Third-Party AI Policies

Our AI features are powered by third-party vendors (such as Google Gemini, OpenAI, and others). By using our AI tools, you agree to comply with the acceptable use policies and terms of service of these underlying vendors.

  • Users are strictly prohibited from submitting prompts that violate these third-party rules, including but not limited to: generating hate speech, requesting explicit content, attempting to bypass or "jailbreak" the AI's safety protocols, or using the AI for illegal activities.
  • PRO X STUDIOS reserves the right to suspend or terminate any account that violates these acceptable use policies.

13. Intellectual Property Rights

The PRO X STUDIOS applications, including but not limited to their original code, design, branding, logos, proprietary Artificial Intelligence (AI) structures, and unique interactive features, are the exclusive property of PRO X STUDIOS and are protected by South African and international copyright, trademark, and intellectual property laws.

  • Public Domain Content: PRO X STUDIOS explicitly does not claim ownership of official national or provincial past examination papers. These documents remain the property of the South African Department of Basic Education (DBE) or the respective provincial departments and are distributed on our platforms as free, public domain educational resources.

14. User Conduct and Content Sharing

Currently, PRO X STUDIOS does not support direct peer-to-peer communication, messaging, or community forums within the application.

  • Users may utilize the built-in "Share" functionality to export or share specific educational problems or app content externally.
  • You agree not to use this sharing functionality to distribute spam, malicious links, or any content that is unlawful, defamatory, or harmful.

15. Anti-Scraping and Unauthorized Access Penalty

To protect the integrity of our platform and our proprietary AI database, you are strictly prohibited from using any automated software, bots, spiders, scrapers, or similar data-gathering tools to access, copy, or monitor any portion of the PRO X STUDIOS applications or websites.

  • Penalty Clause: Should PRO X STUDIOS determine that you have engaged in unauthorized scraping, data mining, or content theft (including but not limited to copying our proprietary code or mirroring our services on a third-party site), PRO X STUDIOS reserves the right to immediately terminate your access. Furthermore, you agree that PRO X STUDIOS may assess, and you will be legally obligated to pay, a penalty of R12,000 (Twelve Thousand South African Rands) per day for every day such unauthorized activity occurs. This penalty is in addition to any other legal remedies or damages PRO X STUDIOS may pursue under South African law.

16. Disclaimer of Warranties ("As Is")

The PRO X STUDIOS applications and all associated services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied. We do not warrant that the AI tools will always be 100% accurate, uninterrupted, or error-free.

17. Limitation of Liability and Indemnification

To the maximum extent permitted by applicable South African law, PRO X STUDIOS, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of or inability to use the services.

  • Academic Liability Shield: You expressly agree that PRO X STUDIOS cannot be held legally or financially responsible for poor academic performance, failed examinations, or disciplinary actions taken by educational institutions against a learner.
  • Indemnification: You agree to indemnify, defend, and hold harmless PRO X STUDIOS from any claims, losses, liability, damages, or costs (including legal fees) arising from your violation of these Terms or your misuse of the applications.

18. Account Deletion and Data Retention

Users have the right to request the permanent deletion of their account and associated personal data at any time.

  • Upon receiving an account deletion request, PRO X STUDIOS will deactivate the account and initiate the removal of your personal information from our active Google servers.
  • For analytical, legal, and security purposes, certain anonymized data or residual account information may be retained in secure backups for a period of up to six (6) months.
  • The exact retention period of certain data may also be subject to the distinct privacy policies and data retention schedules of the third-party vendors utilized by PRO X STUDIOS.
